NOTICE OF PRIVACY
INTELLEGO SC

This document is the Notice of Privacy for purposes of the Federal Law for the Protection of Personal Data in Possession of Private Companies or Individuals (hereinafter referred as "LFPDP") and provisions arising from or associated with it. This Notice of Privacy applies to personal information collected on the Office Holder by INTELLEGO SC in its capacity as Responsible. This Notice of Privacy has the following terms and conditions:
  1. TERMS. For purposes of this Notice of Privacy, the following terms shall have the following meanings unless are otherwise defined herein. The terms used in this Notice of Privacy and not defined herein shall have the meaning ascribed to them in the LFPDP:
    "Personal Data" Refers to any information concerning an identified or identifiable individual.
    "ARCO Rights" Means the rights of access, rectification, cancellation and opposition in accordance with the provisions of the LFPDP and subject to the exceptions set forth therein and in this Notice of Privacy, which each Office Holder has, in relation to the Personal Data collected by the Manager and/or the Person in Charge, described below:
    "Right of Access" Is the right of the Office Holder to know about the Personal Data related to him held by the Manager or the Person in Charge, and also to whom have been shared and for what purpose. "Right of Correction" Each Office Holder is entitled to have their Personal Data rectified whenever it is inaccurate or incomplete.
    "Right to Cancel" Each Office Holder is entitled to request, at any time, Personal Data to be deleted, which will happen once the blocking period expires. Blocking involves the identification and conservation of Personal Data, once it meets the purpose for which Data was collected, and it is intended to identify potential liabilities in relation to its treatment, until its legal or contractual limitation period comes to an end. During this period, Personal Data will not be processed and when finished will proceed with its cancellation in the database or corresponding file. After canceling the relevant data, the Manager will give appropriate notice to the Office Holder. In case Personal Data has been transmitted before the date of correction or cancellation and continued to be treated by others, the Manager will inform the third party, the request for correction or cancellation, to proceed accordingly.
    "Right of Opposition" Under legitimate cause the Office Holder has the right at any time to request to stop handling Personal Data by the Manager.
    "Manager" means the individual or legal person that decides how to handle Personal Data of the Office Holder, in this case INTELLEGO, SC
    "Person in Charge" means the individual or legal person who by its own or jointly with others handles Personal Data on behalf of the Manager.
    "Office Holder" means the individual owner of the Personal Data, or the one authorized to supply third party Personal Data pursuant to applicable law, and who delivers such Personal Data to the Manager.
  2. CONSENT OF THE OFFICE HOLDER. For purposes of the stated in the LFPDP and particularly its Article 17, the Office Holder declares (i) that this Notice of Privacy has been shared by the Manager, (ii) that have read, understood and agreed to the terms set in this Notice of Privacy, so consents with respect to the processing of their personal data for purposes of the LFPDP and other applicable legislation. If Personal Data collected includes sensitive or financial data, based on a contract, whether in hard copy or electronic means and the corresponding processes for the formation of the consent, for example -without limitation but not limited to - by providing personal data through the dialog boxes, or through display and tour screens of the terms and conditions, the acts to perform the collection shall be carried out and constitute the express consent of the owner in terms of the second paragraph of Article 8 of the LFPDP and other applicable law and (iii) that grants consent to INTELLEGO or their Person in Charge to make transfers of Personal Data to national or foreign third parties, provided that such third parties to treat Personal Data in compliance with the provisions this Notice of Privacy.
    In case the Office Holder has no objection to the terms of this Notice of Privacy within the next 30 days of its reception, the content therein would be accepted and consented according to the terms of the third paragraph of Article 8 of the LFPDP. The Office Holder can revoke his consent at any time without retroactive effect in accordance with the terms and procedures set forth below to do so under this Notice of Privacy.
    Notwithstanding any provision of this Notice of Privacy, the Office Holder acknowledges that his consent is not required for processing Personal Data by the Manager or by third parties in any of the cases mentioned in Article 10 of the LFPDP.
  3. PURPOSE OF THE NOTICE OF PRIVACY; PURPOSE OF PERSONAL DATA. This Notice of Privacy is made to establish the terms and conditions under which INTELLEGO SC (or the Person in Charge designated by INTELLEGO SC) (i) will receive and protect the Personal Data of the Office Holder in order to protect their privacy and right to informational self-determination in accordance with the provisions of the LFPDP (ii) will use the Personal Data of the Office Holder, and (iii) will conduct the transfer of Personal Data to third parties.
    The Manager will collect and process Personal Data of the Office Holder, meaning the information that can identify you in a reasonable manner, through the receipt of documents, whether in print and/or digital. The following are examples –including but not limited to- of the information that can be collected by the Manager: full name, date of birth, home and legal address, personal and work e-mails, home and office phone numbers, cell phone number, credit and debit card numbers, bank account number, Federal Taxpayers ID (RFC), Single Population Identification Code (CURP), Affiliation Number of the Mexican Institute of Social Security, as well as consumer and browsing preferences by making use of the telecommunications services we provide and similar. Collection of Personal Data can be made when the Office Holder visits Manager or authorized dealers POS, when communicating by telephone with the Manager or with the Person in Charge (including customer service centers), by hand delivery to the Manager, through the use of email and/or short text messages (SMS), by using their Web sites to provide voluntary information through dialog windows enabled in the sites, or by using automatic capture data tools. These tools allow the collection of the information that your browser sends to these Web sites, such as the type of browser you use, the user language, access times and the IP address of websites that you used to access sites of the Manager or Person in Charge. Among the documents that can be collected by INTELLEGO SC to verify the identity of the Office Holder of the Personal Data are the IFE credential; the released military service identity card; the certificate of registration in the RFC; the certificate of registration of the CURP; proof of address – pay receipt of water rights, property tax or electricity supply services bills-; the special credit report issued by a Credit Information Company.
    The Manager may also collect Personal Data from publicly available sources and other sources available in the market to which the Office Holder may have given consent to share the personal information or that have been provided of anonymous demographic information associated with a particular geographical area.
    Office Holder's Personal Data is collected and processed by the Manager or by the Person in Charge in order to allow the Office Holder to perform the following activities with the Manager:
    1. Order, buy, change, or return products and/or services offered by INTELLEGO SC, whether provided by the company or through third parties;
    2. Request, hire, change or cancel services offered by INTELLEGO SC, whether provided by the company or through third parties;
    3. Make payments online;
    4. Request digital tax invoices or vouchers;
    5. To request a quote, information or free samples of products and services;
    6. Request the delivery, repair or warranty compliance of the products;
    7. Request services or the warranty compliance of the services;
    8. Contact the Customer Service department;
    9. To receive print or electronic advertising, including communications for online marketing, or telemarketing about products and services;
    10. Create personal profiles;
    11. Participate in surveys;
    12. Use the services in their related websites including downloading of contents and formats;
    13. Notify the Manager about any problems with their sites;
    14. Participate in chat rooms and/or in online discussion forums about the products and services;
    15. To participate in polls, trivia, contests, raffles, games and sweepstakes;
    16. Share your comments or suggestions about products and services;
    17. Process payments, and
    18. Any other activity of a similar nature to those described in the articles previously mentioned.
    Also, the Manager directly or through their Person in Charge, may use your Personal Data for the following purposes:
    1. Conduct studies on the demographics, customers’ interests and behaviors, consumers, suppliers, and third parties;
    2. Conduct market and consumer researches in order to acquire and offer professionalized products and services, as well as advertising and contents best suited to the needs of its clients, customers, suppliers and other third parties in business;
    3. Develop internal statistics that indicate the products and services most valued by different segments of customers, consumers, suppliers and other users of telecommunications services provided by the Manager;
    4. To formalize the transaction process with customers, consumers, suppliers and other third parties in business;
    5. Manage the requisition, evaluation and adjudication process of suppliers and other third parties in business;
    6. If applicable, verify creditworthiness and/or payment of the Office Holder which shall be conducted through the credit information companies, in terms of the Law to regulate the Credit Information Companies;
    7. Check the commercial transactions done by the Office Holder with the Manager;
    8. Keep a record of transactions and information reviewed in the various sections of the telecommunications services provided by the Manager and collected through tools of automatic data capture;
    9. Send to the Office Holder the notification of offers, notices and/or promotional messages that will be sent, unless the Office Holder expressly states his desire not to receive such offers. Occasionally, such offers may contain information of providers of the Manager or of other third parties.
    INTELLEGO SC requires sharing your Personal Data with management service providers and database management; automatic processing of the Personal Data and storage; authentication and validation of emails; personnel recruitment, auditing services, and other similar services to the described above.
    Data collection while browsing INTELLEGO SC sites and websites.- Cookies, Web beacons and links in emails are included in the automatic data capture tools used by INTELLEGO SC.
    Use of Cookies.- The optimal functioning of INTELLEGO SC sites and its suppliers requires enabling "cookies" in their Internet browser. Cookies are small data files transferred by the Web site to the hard drive of your computer when browsing the site. Cookies may be by session or permanent. Session cookies do not stay on your computer after you close your browser session, while the permanent cookies remain on computers until they are removed or expire. Most browsers automatically accept cookies under its default settings, nevertheless you can set your browser preferences to accept or decline cookies. Disabling cookies may disable various features of websites of INTELLEGO SC or not to display them correctly. In case you want to remove the information from cookies sent by INTELLEGO SC you can delete the file(s) at the end of each browser session. Relevant information can be found at the sites of the major Internet browsers.
    Using Web beacons (also known as Internet tags, pixel tags and clear GIFs). - INTELLEGO SC can use on its websites and in emails with HTML format Web beacons alone or in combination with cookies, to collect information while in use of web sites and their interaction with email. A Web beacon is an electronic image, known as single-pixel (1x1) or GIF that can recognize information that is processed on your computer, such as cookies, and the time and date in which the site and its sections are displayed.
    Links in emails of INTELLEGO SC.- Emails that include links that enable INTELLEGO SC know if you activated the link and visited the destination website, can be included in your profile. If you prefer INTELLEGO SC not to collect information about your interaction with these links, you can choose to modify the format of INTELLEGO SC communications (for example, that the message is received as text and not as HTML) or you can ignore the link and not access to the content. INTELLEGO SC emails may include links designed to direct you to the relevant sections of the Web sites by re-routing it through INTELLEGO servers. The redirection system allows INTELLEGO SC to modify URL of those links if necessary, also allows INTELLEGO SC to determine the effectiveness of their online marketing campaigns. The Personal Data INTELLEGO SC obtains from commercial sources may be used together with the personal data collected through its websites. For example, INTELLEGO SC may compare the separate geographic information acquired from commercial sources with the IP address collected by the tools of automated data collection in order to provide relevant information and promotions for your geographic area.
    Child Protection.- INTELLEGO SC encourages parents and/or guardians to take an active role in the online activities of their children. Whenever INTELLEGO SC considers that the personal data have been provided by a minor in violation of this Notice of Privacy, INTELLEGO SC will remove such personal data as soon as possible. If you become aware that such personal data has been provided by an individual less than 18 years of age, please send an email to: contacto@intellego.com.mx.
  4. DATA TRANSFERS. Having read, understood and agreed to the terms set out in this Notice of Privacy, the Office Holder expresses his consent to make transfers of Personal Data to national or foreign third parties by the Manager or Person in Charge, with the understanding that the treatment given by those third parties to the Personal Data of the Office Holder must comply with the provisions of this Notice of Privacy.
    For purposes of the provisions of this Section 4, but subject to the provisions of the last paragraph of the same, the Manager informs the Office Holder that in order to deliver products, services and solutions to its clients, customers, employees, suppliers and other users of its services, the Manager and/or the Person in Charge have concluded or will conclude trade agreements with suppliers of products and services, both nationally and abroad, that will provide, among other services: telecommunications and email, databases administration and management, automatic processing of Personal Data and storage, call center for customer service, authentication and validation of emails, telemarketing, credit card terminals, electronic billing, marketing, transportation and product installation, administration of payroll and social security benefits, hiring personnel, auditing services and other similar services. Office Holder's authorization granted under Section 4 empowers the Manager and/or their Person in Charge to transmit Personal Data of the Office Holder to such suppliers, provided that such providers are obliged, by virtue of the relevant contract, to maintain the confidentiality of the Personal Data provided by the Manager and/or their Person in Charge and to observe this Notice of Privacy. The Manager and/or its Person in Charge may transfer Personal Data collected from the Office Holder to any other company in the same corporate group to which the Manager belongs to and which operate with the same internal processes and policies, whether they are in the national territory or abroad for the same purposes described in this Notice of Privacy. You can also transfer your personal data to other third parties to fulfill contracts or legal relationships with the Office Holder.
    Your personal information may be transferred, stored and processed in a country other than where it was provided. If it is the case the data will be transferred in accordance with the laws of data protection applicable in the destination country. We take steps to protect personal information regardless of the country where it is stored or transferred. We have procedures and appropriate controls to ensure this protection.
    We reserve the right to transfer the Personal Data in case the company or assets are partially or totally sold or transferred. If a sale or transfer occurs, we will encourage the next owner to use Personal Data in accordance with this Notice. If you do not want your Personal Data to be processed after the transfer, you must contact the new owner.
    Notwithstanding the provisions of this Section 4 or elsewhere in this Notice of Privacy, the Office Holder acknowledges and agrees that the Manager does not require authorization or confirmation of the Office Holder for transferring national or international Personal Data in the cases provided in Article 37 of the LFPDP or otherwise for exceptions provided by the same or other applicable legislation.
  5. RETENTION AND SECURITY OF PERSONAL DATA. The Manager and/or their Office Holder will retain Personal Data of the Office Holder during the time necessary to process your requests for information, products and/or services, and to maintain accounting records, financial and audit in terms of the LFPDP and commercial law, tax and administrative regulations. Holder's Personal Data collected by the Manager and/or the Person in Charge will be protected by administrative, technical and physical security measures against damage, loss, alteration, destruction or use, unauthorized access or treatment, in accordance with the LFPDP and in the administrative regulation derived therefrom. Notwithstanding the above, INTELLEGO SC does not guarantee that unauthorized parties can’t be able to access to the hardware or software of the Office Holders or of the Manager or to the electronic documents and files stored in their systems. Consequently, INTELLEGO SC shall in no way be responsible for any damages that may result from such unauthorized access.

    For purposes of the provisions of Section I of Article 16 of the LFPDP, the legal address of the Manager is established in Section 6 of this Notice of Privacy.
  7. PROCEDURE TO EXERCISE ARCO RIGHTS. To exercise the ARCO Rights, the Office Holder or his representative must file a request for access, rectification, cancellation or opposition along with the following information and documentation:

    i. Name and address of the Office Holder or other means to communicate the answer to your request;
    ii. Documents proving your identity (non-certified copy in printed or electronic format of the Federal Registry of Voters ID, passport or FM-3) or, if applicable, the legal documentation of the Office Holder (non-certified copy in printed or electronic format of the Power of Attorney with hand written signature of the Office Holder and of the Representative and their official IDs – Federal Registry of Voters ID, passport or FM-3);
    iii. The clear and precise description of the Personal Data for which seeks to exercise any ARCO rights, and
    iv. Any other item or document facilitating the location of the Personal Data of the Office Holder.

    In the case of Personal Data rectification requests, the relevant Office Holder must also indicate the changes to be made and provide the documentation supporting your request. For the reception, registration and attention of requests to exercise their right of access, rectification, cancellation and opposition of Personal Data and to limit its use or disclosure, and for other rights under the LFPDP please contact:

    The Manager or their Person in Charge will respond to the Office Holder within a maximum of twenty working days from the date of receipt of the request for access, rectification, cancellation or opposition, to the effect that, if it is appropriate, will be allocated the same within fifteen days of the date on which the response is communicated to the Office Holder. In the case of requests for access to Personal Data, the Manager or Person in Charge will proceed with delivery with proof of identity of the applicant or his legal representative, as appropriate. The periods referred to above may be extended only in terms of the LFPDP.
    Delivery of Personal Data is free of charge; only justified shipping costs or the cost of reproduction in copies or other formats will be needed. In the event the Office Holder reiterates its request in less than twelve months, Office Holder shall cover the costs equivalent to 1.5 days of the Updated Minimum Wage in Mexico City in terms of the LFPDP, unless there are substantial changes to the Notice of Privacy motivating further consultations.
    For purposes of a cancellation request of Personal Data, in addition to the provisions of this Notice of Privacy, will rule the provisions of Article 26 of the LFPDP, including the exceptional cases of cancellation of Personal Data listed there.
    Filing an objection request of the use of Personal Data by the Office Holder thereof, entitles the Manager to object to the use of the Personal Data delivered as Office Holder to the opponent.
  8. CHANGES TO THIS NOTICE OF PRIVACY. INTELLEGO SC reserves the right to update this Notice periodically to reflect changes in the information practices. It is the responsibility of the Office Holder to revise the content of the Notice of Privacy visiting www.intellego.com.mx site. If not expressed otherwise, the Manager will assume that the owner has read, understood and agreed to the terms set out therein, what constitutes his consent to the changes set out in the updates regarding the processing of the Personal Data for the purposes of the LFPDP and other applicable legislation.
